They can be charged as Felonies or Misdemeanors, usually, depending on the damage to the person claiming to be attacked. The difference between an Assault and a Battery is one of Intent. Battery is a General Intent crime (willfully do the act) and Assault requires the Intent to harm or offend the person.

In 18 years I’ve never seen a case where there wasn’t some provocation and build up to a fight. There’s always multiple stories and multiple witnesses.  The person charged usually depends on the Arresting Officers personal ’s bias or which person talked to the cops first.
